Six
Golden Rules and One Guiding Principle for
Effective
Patent Protection in Italy
“Why
should someone take specific measures in order to achieve patent protection
in a country where the Patent Office does not carry out any prior art search
and any substantive examination ?”.
In
Italy, as you do not write for the Patent Office, you should write at least
for the Court. In fact, the ultimate evaluation of your patent will take
place before a Court during an infringement suit and will be carried out
by a Judge. It is important to take this into account when drafting your
patent applications. The fact that only 1 patent over 100 will be litigated
does not help, in fact you cannot predict which patent will be.
This
article provides hints that may be useful for an effective patent protection
in Italy.
Both
the national route and the European route are considered.

EUROPE
: two steps further towards software patenting
This
present article provides some practical hints on how to exploit at best
:
1) the recent developments in the case-law of the European
Patent Office on computer-related inventions; and
2) the amendments to the European patent law relating to programs
for computers due to the recent Revision of the European Patent Convention.
Also
considered is the new situation that is likely to be established in the
European countries after such a Revision.
